    Section 4740.12 - Ohio Revised Code | Ohio Laws

    (A) No political subdivision, district, or agency of the state may adopt an ordinance or rule that requires contractor registration and the assessment of a registration or license fee unless that ordinance or rule also requires any contractor who registers and pays the registration or license fee to be licensed in the contractor's trade pursuant to this chapter. (B) Except as provided in division (A) of this section, nothing in this chapter shall be construed to limit the operation of any statute or rule of this state or any ordinance or rule of any political subdivision, district, or agency of the state that does either of the following: (1) Regulates the installation, repair, maintenance, or alteration of plumbing systems, hydronics systems, electrical systems, heating, ventilating, and air conditioning systems, or refrigeration systems; (2) Requires the registration and assessment of a registration or license fee of tradespersons who perform heating, ventilating, and air conditioning, refrigeration, electrical, plumbing, or hydronics construction, improvement, renovation, repair, or maintenance.

    Section 715.27 - Ohio Revised Code | Ohio Laws

    (A) Any municipal corporation may: (1) Regulate the erection of fences, billboards, signs, and other structures, within the municipal corporation, and provide for the removal and repair of insecure billboards, signs, and other structures; (2) Regulate the construction and repair of wires, poles, plants, and all equipment to be used for the generation and application of electricity; (3) Provide for the licensing of house movers; plumbers; sewer tappers; vault cleaners; and specialty contractors who are not required to hold a valid license issued pursuant to Chapter 4740. of the Revised Code; (4) Require all specialty contractors other than those who hold a valid license issued pursuant to Chapter 4740. of the Revised Code, to successfully complete an examination, test, or demonstration of technical skills, and may impose a fee and additional requirements for a license or registration to engage in their respective occupations within the jurisdiction of the municipal corporation. (B) No municipal corporation shall require any specialty contractor who holds a valid license issued pursuant to Chapter 4740. of the Revised Code to complete an examination, test, or demonstration of technic

  • OAC 1301:17-1-04

    Rule 1301:17-1-04 | Out of state applicants.

    (A) An applicant for an initial Ohio home inspector license may obtain a license pursuant to section 4764.10 of the Revised Code provided the following, including but not limited to, are satisfied: (1) The applicant completes an application prescribed by the superintendent; (2) The applicant submits to criminal background check as found in division (B) of section 4764.07 of the Revised Code; (3) The applicant satisfies all the requirements of section 4764.10 of the Revised Code; and (4) Payment of appropriate fees required by paragraph (A) of rule 1301:17-1-03 of the Administrative Code. (B) Any applicant for an Ohio home inspector license who is doing business in Ohio as, including but not limited to, a sole proprietor, a corporation, a partnership, limited liability corporation, limited liability partnership or an association shall file or register with the Ohio secretary of state. (C) The signature on any application may be written by hand or be an electronic signature, as defined by division (H) of section 1306.01 of the Revised Code.     Section 4740.04 - Ohio Revised Code | Ohio Laws

    The administrative section of the Ohio construction industry licensing board is responsible for the administration of this chapter and shall do all of the following: (A) Schedule the contractor examinations each of the other sections of the board directs. Each type of examination shall be held at least four times per year. (B) Select and contract with one or more persons to do all of the following relative to the examinations: (1) Prepare, administer, score, and maintain the confidentiality of the examinations; (2) Be responsible for all the expenses required to fulfill division (B)(1) of this section; (3) Charge an applicant a fee in an amount the administrative section of the board authorizes for administering the examination. (C) Issue and renew licenses as follows: (1) Issue a license to any individual who the appropriate specialty section of the board determines is qualified pursuant to section 4740.06 of the Revised Code to hold a license and has attained, within the twelve months preceding the individual's application for licensure, a score on the examination that the appropriate specialty section authorizes for the licensed trade.     Section 315.14 - Ohio Revised Code | Ohio Laws

    The county engineer shall be responsible for the inspection of all public improvements made under authority of the board of county commissioners. The engineer shall keep in suitable books a complete record of all estimates and summaries of bids received and contracts for the various improvements, together with the record of all estimates made for payments on that work. The engineer shall make all surveys required by law, shall perform all necessary services to be performed by a registered surveyor or registered professional engineer in connection with the construction, repair, or opening of all county roads or ditches constructed under the authority of the board, and shall perform other duties as the board requires, provided that the duties described in sections 307.37 and 307.38 and Chapters 343., 6103., and 6117. of the Revised Code shall be performed only pursuant to an agreement between the county engineer and the board. An agreement of that type may provide for the county engineer's performance of duties described in one or more of those sections or chapters, and may provide for the county engineer's performance of all duties imposed upon a county sanitary engineer under Chapt

    Section 4740.01 - Ohio Revised Code | Ohio Laws

    As used in this chapter: (A) "License" means a license the Ohio construction industry licensing board issues to an individual as a heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, or hydronics contractor. (B) "Contractor" means any individual or contracting company that satisfies both of the following: (1) Has responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance on a construction project with respect to one or more trades and who offers, identifies, advertises, or otherwise holds out or represents that the individual or contracting company is permitted or qualified to perform or have responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance with respect to one or more trades on a construction project; (2) Does either of the following: (a) Performs construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trade; (b) Employs tradespersons who perform construction, improvement, or renovation on a construction project with respect

    Section 3965.07 - Ohio Revised Code | Ohio Laws

    (A) A licensee is exempt from the requirements of section 3965.02 of the Revised Code if it meets any of the following criteria: (1) The licensee has fewer than twenty employees. (2) The licensee has less than five million dollars in gross annual revenue. (3) The licensee has less than ten million dollars in assets, measured at the end of the licensee's fiscal year. (B)(1) A licensee subject to and in compliance with the privacy and security rules of 45 C.F.R. Parts 160 and 164 shall be deemed to meet the requirements of this chapter, except those pertaining to notification under section 3965.04 of the Revised Code. The licensee shall submit a written statement to the superintendent certifying its compliance with 45 C.F.R. Parts 160 and 164. The information furnished by a licensee pursuant to section 3965.04 of the Revised Code shall be confidential in accordance with section 3965.06 of the Revised Code. Each licensee shall maintain for examination by the superintendent all records, schedules, and data supporting the certificate of compliance for a period of five years.     The superintendent of industrial compliance shall appoint such number of plumbing inspectors as is required. The inspectors shall be practical plumbers with at least seven years' experience, and skilled and well-trained in matters pertaining to sanitary regulations concerning plumbing work.

    Licensees from other jurisdictions

    The superintendent of real estate and professional licensing may issue a home inspector license to applicants holding equivalent credentials from other jurisdictions, provided they submit an application, pay required fees, and meet specified requirements. These include: the applicant's jurisdiction must grant reciprocal privileges to Ohio licensees; licensing requirements must be substantially similar to or exceed Ohio's standards; the applicant must attest to familiarity with Ohio law; and the applicant must provide service of process information and consent to Ohio court jurisdiction. Additionally, the board shall issue licenses to applicants holding licenses in another state or possessing satisfactory work experience, government certification, or private certification as a home inspector in states without licensing requirements, as described in Chapter 4796 of the Revised Code.

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09. The application shall be on the form the section prescribes.

    (B) To qualify to take an examination, an individual shall: be at least eighteen years of age; be a United States citizen or legal alien; either have been a tradesperson in the type of licensed trade for not less than five years immediately prior to the application date, be a currently registered engineer in this state with three years of business experience in the construction industry, or have other experience acceptable to the appropriate specialty section; maintain contractor's liability insurance; and not have violated this chapter, obtained a license through fraud, or engaged in fraud or deception in business conduct.

    (C) For an individual who holds an out-of-state occupational license that is substantially similar, to qualify to take an examination, the individual shall provide proof of authorizations for construction, tax returns reflecting income earned, and proof tha

    Section 6117.011 - Ohio Revised Code | Ohio Laws

    A board of county commissioners in the manner provided in this section may make surveys of water supply, sanitary facilities, drainage facilities, or prevention or replacement facilities for any sewer district, the acquisition or construction of which is contemplated. Any board desiring to make a survey shall adopt a resolution declaring its purpose and necessity. In making the surveys, the board may call upon engineering officers or employees regularly employed by the board or may authorize and enter into contracts for the services of registered professional engineers to make the surveys. The surveys authorized by this section may include drawings, plans, specifications, estimates of cost of labor and materials, other items of cost, assessment rolls, and other facts, material, data, reports, and information and recommendations that the board considers advisable or necessary for the purpose. Contracts entered into for the surveys shall be considered contracts for professional services and may provide for preliminary surveys or the making of detailed plans, or both, and also may provide for engineering supervision of the work.   • Ohio Rev. Code § 4764.07

    Application for license

    To obtain a home inspector license in Ohio, applicants must submit an application form and fee to the superintendent of real estate and professional licensing. Applicants must provide fingerprints for criminal background checks, including FBI records. Requirements include proof of liability insurance, passing the national home inspector exam within two years, completing board-approved education, and demonstrating experience through either a curriculum or ten parallel inspections. Applicants must be at least 18 years old and have a high school diploma or equivalent. Certain individuals with prior licensure in related fields may be exempt from education and experience requirements but must meet all other criteria. The superintendent issues licenses to qualified applicants, subject to section 4768.14. Submission of an application does not constitute licensure.
