    License application

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09. The application shall be on the form the section prescribes.

    (B) To qualify to take an examination, an individual shall: be at least eighteen years of age; be a United States citizen or legal alien; either have been a tradesperson in the type of licensed trade for not less than five years immediately prior to the application date, be a currently registered engineer in this state with three years of business experience in the construction industry, or have other experience acceptable to the appropriate specialty section; maintain contractor's liability insurance; and not have violated this chapter, obtained a license through fraud, or engaged in fraud or deception in business conduct.

    (C) For an individual who holds an out-of-state occupational license that is substantially similar, to qualify to take an examination, the individual shall provide proof of authorizations for construction, tax returns reflecting income earned, and proof tha

    Section 715.27 - Ohio Revised Code | Ohio Laws

    (A) Any municipal corporation may: (1) Regulate the erection of fences, billboards, signs, and other structures, within the municipal corporation, and provide for the removal and repair of insecure billboards, signs, and other structures; (2) Regulate the construction and repair of wires, poles, plants, and all equipment to be used for the generation and application of electricity; (3) Provide for the licensing of house movers; plumbers; sewer tappers; vault cleaners; and specialty contractors who are not required to hold a valid license issued pursuant to Chapter 4740. of the Revised Code; (4) Require all specialty contractors other than those who hold a valid license issued pursuant to Chapter 4740. of the Revised Code, to successfully complete an examination, test, or demonstration of technical skills, and may impose a fee and additional requirements for a license or registration to engage in their respective occupations within the jurisdiction of the municipal corporation. (B) No municipal corporation shall require any specialty contractor who holds a valid license issued pursuant to Chapter 4740. of the Revised Code to complete an examination, test, or demonstration of technic

    Section 4740.04 - Ohio Revised Code | Ohio Laws

    The administrative section of the Ohio construction industry licensing board is responsible for the administration of this chapter and shall do all of the following: (A) Schedule the contractor examinations each of the other sections of the board directs. Each type of examination shall be held at least four times per year. (B) Select and contract with one or more persons to do all of the following relative to the examinations: (1) Prepare, administer, score, and maintain the confidentiality of the examinations; (2) Be responsible for all the expenses required to fulfill division (B)(1) of this section; (3) Charge an applicant a fee in an amount the administrative section of the board authorizes for administering the examination. (C) Issue and renew licenses as follows: (1) Issue a license to any individual who the appropriate specialty section of the board determines is qualified pursuant to section 4740.06 of the Revised Code to hold a license and has attained, within the twelve months preceding the individual's application for licensure, a score on the examination that the appropriate specialty section authorizes for the licensed trade.     Section 4740.06 - Ohio Revised Code | Ohio Laws

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09 of the Revised Code. The application shall be on the form the section prescribes. The applicant shall provide information satisfactory to the section showing that the applicant meets the requirements of division (B), (C), or (D) of this section. (B) To qualify to take an examination, an individual shall: (1) Be at least eighteen years of age; (2) Be a United States citizen or legal alien who produces valid documentation to demonstrate the individual is a legal resident of the United States; (3) Either have been a tradesperson in the type of licensed trade for which the application is filed for not less than five years immediately prior to the date the application is filed, be a currently registered engineer in this state with three years of business experience in the construction industry in the trade for which the engineer is applying to take an examination, or have other experience acceptable to the appropriate specialty section of the b

    Prohibiting practice without certificate

    No person may practice architecture or hold forth as an architect without a certificate of qualification issued under Ohio Revised Code sections 4703.01 to 4703.19. The statute provides exemptions allowing non-architects to file building permit applications and prepare plans for residential buildings, replacement equipment installations, and certain modifications where building officials determine no plans are required. Registered professional engineers may engage in architectural practice incident to engineering, and architects may engage in engineering practice incident to architecture. Firms, partnerships, associations, limited liability companies, and corporations may provide architectural services only through registered natural persons and must comply with ownership and management requirements. More than fifty percent of partners, members, shareholders, directors, managers, or trustees must be licensed professionals who own more than fifty percent of interests. Each entity must designate trustees, partners, managers, or directors in responsible charge of professional activities, and corporations must obtain certificates of authorization from the architects board.

Registered professional engineers may engage in architectural practice incident to engineering, and architects may engage in engineering practice incident to architecture. Firms, partnerships, associations, limited liability companies, and corporations may provide architectural services only through registered natural persons and must comply with ownership and management requirements. More than fifty percent of partners, members, shareholders, directors, managers, or trustees must be licensed professionals who own more than fifty percent of interests. Each entity must designate trustees, partners, managers, or directors in responsible charge of professional activities, and corporations must obtain certificates of authorization from the architects board.

    (A) Notwithstanding any other provision of this chapter, any person who performs labor or who provides services pursuant to a construction contract may offer or provide architectural services in connection with the person's own labor or services if all of the following apply: (1) The architectural services are provided and performed by an architect registered under this chapter or by a firm holding a certificate of authorization granted pursuant to this chapter through either direct employment or independent contract with the person contracting with the owner and offering the services. (2) The architectural services are offered by the person who intends to perform the actual construction of an improvement to real property as part of a design-build contract. (3) The contractor, the architect registered under this chapter, or the firm holding a certificate of authorization granted pursuant to this chapter meets the requirements of section 153.70 of the Revised Code when design-build services are provided to a public authority as defined in section 153.65 of the Revised Code.     With respect to a person registered or licensed to engage in the practice of engineering or surveying by a proper authority of another state, territory, or possession of the United States, or the District of Columbia, or who has a government certification or private certification as an engineer or surveyor in another state, territory, or possession of the United States, or the District of Columbia that does not issue that registration or license, the state board of registration for professional engineers and surveyors shall register the person as a professional engineer or surveyor in accordance with Chapter 4796. of the Revised Code. Notwithstanding section 4796.05 of the Revised Code, the board shall register a person who has satisfactory work experience as a professional engineer or surveyor in accordance with Chapter 4796. of the Revised Code if the person satisfies a minimum education requirement and passes an examination.     The board of county commissioners may purchase or lease beds of limestone, or other suitable road-building material, after such material is approved by the director of transportation as suitable for the construction of roads, or such board may lease and operate a plant for the manufacture of brick or other road-building materials or supplies needed for the construction or maintenance of public roads in such county and employ a superintendent to supervise the work.     (A) Notwithstanding any other provision of sections 4703.30 to 4703.49 of the Revised Code, any person performing labor or providing services pursuant to a construction contract may offer or provide landscape architectural services in connection with the person's other labor or services if all of the following apply: (1) The person employs a landscape architect registered under sections 4703.30 to 4703.49 of the Revised Code or enters into a contract with a firm, partnership, association, limited liability company, or corporation with a valid certificate of authorization granted under sections 4703.30 to 4703.49 of the Revised Code to provide landscape architectural services. (2) The person intending to perform the actual construction of an improvement to real property as part of a design-build contract offers the landscape architectural services. (3) The contractor, the landscape architect registered under sections 4703.30 to 4703.49 of the Revised Code, or the firm, partnership, association, limited liability company, or corporation with a valid certificate of authorization granted under section 4703.331 of the Revised Code meets the requirements of section 153.70 of the Revised

    Rule 4781-8-05 | Installation, foundation, and base support system construction work performed by unlicensed persons.

    Except as provided in rule 4781-8-05.1 of the Administrative Code, no person shall install a manufactured home or perform foundation and base support system construction in Ohio unless licensed by the division or under the supervision of a licensed installer. A licensed manufactured home installer will be responsible for any installation tasks, including foundation and base support system construction work, that an unlicensed person performs on a manufactured home.

    Rule 4781-8-06 | Education for applicants.

    (A) General education requirements for installer's license applications. (1) An applicant shall successfully complete twelve hours of initial licensing education as set forth in paragraph (A)(2) of this rule. The required education shall be completed within one year of the date of application. Credit shall only be given for courses that have been approved by the division. (2) The curriculum of any initial licensing education course shall include instruction in the following areas: (a) Ohio law governing manufactured home installation; (b) Manufacturers' installation manuals and requirements; (c) Preparation of manufactured home sites, including drainage; (d) Installation of foundation systems, including calculation of loads from roof to column to footing, and calculation of footing size; (e) Blocking, perimeter support, and leveling of manufactured homes; (f) Connections of sections and components; (g) Installation of anchoring systems and components; (h) Installation of vapor barriers, curtain walls, access, and ventilation for crawl space areas; (i) Instruction in all areas included on inspection checklists on forms provided by the division; (j) Work place safety for installers;

  • Ohio Rev. Code § 4740.08

    Section 4740.08 - Ohio Revised Code | Ohio Laws

    When a written reciprocity agreement between the states exists, and an individual who is registered, licensed, or certified in another state applies to the appropriate specialty section of the Ohio construction industry licensing board submits a copy of the reciprocity agreement, and pays the licensure fee determined pursuant to section 4740.09 of the Revised Code, the appropriate specialty section of the board shall authorize the administrative section to issue, without examination, a license to that individual if the appropriate specialty section of the board determines, pursuant to rules it adopts, that the requirements for registration, licensure, or certification under the laws of the other state are substantially equal to the requirements for licensure in this state and that the other state extends similar reciprocity to persons licensed under this chapter. The appropriate specialty section of the board may withdraw its authorization to the administrative section for issuance of a license for good cause prior to the administrative section's issuance of the license. An individual who is issued a license under this section is not required to obtain a license under section 4740.

    Section 4703.35 - Ohio Revised Code | Ohio Laws

    (A) The Ohio landscape architects board shall register as a landscape architect any individual who is at least eighteen years of age and who provides evidence satisfactory to the board that the individual is a registered or licensed landscape architect in another country in which the qualifications, at the time of licensure, were substantially equal, in the opinion of the board, to the requirements for registration as a landscape architect in this state. The board may require that an applicant for registration under this division hold a current council record or certificate in good standing issued by the council of landscape architectural registration boards. (B) The board shall register as a landscape architect in accordance with Chapter 4796. of the Revised Code an individual if either of the following applies: (1) The individual holds a registration or license as a landscape architect in another state. (2) The individual has satisfactory work experience, a government certification, or a private certification as described in that chapter as a landscape architect in a state that does not issue that registration or license.     | Construction industry licensing board definitions.   Effective: September 17, 2014 Latest Legislation: Senate Bill 78 - 130th General Assembly PDF: Download Authenticated PDF   As used in this chapter: (A) "License" means a license the Ohio construction industry licensing board issues to an individual as a heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, or hydronics contractor. (B) "Contractor" means any individual or contracting company that satisfies both of the following: (1) Has responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance on a construction project with respect to one or more trades and who offers, identifies, advertises, or otherwise holds out or represents that the individual or contracting company is permitted or qualified to perform or have responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance with respect to one or more trades on a construction project; (2) Does either of the following: (a) Performs construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trade; (b) Employs tradespersons who perform construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trades. (C) "Contracting company" means a company in the construction industry working on construction projects. (D) "Licensed trade" means a trade performed by a heating, ventilating, and air conditioning contractor, a refrigeration contractor, an electrical contractor, a plumbing contractor, or a hydronics contractor. (E) "Tradesperson" means any individual who is employed by a contractor and who engages in construction, improvement, renovation, repair, or maintenance of buildings or structures without assuming responsibility for the means, method, or manner of that construction, improvement, renovation, repair, or maintenance. (F) "Construction project" means a construction project involving a building or structure subject to Chapter 3781. of the Revised Code and the rules adopted under that chapter, but not an industrialized unit or a residential building as defined in section 3781.06 of the Revised Code.
