    (A) The division of industrial compliance shall issue a manufactured housing installer license to any applicant who is at least eighteen years of age and meets all of the following requirements: (1) Submits an application to the division on a form the division prescribes; (2) Completes all training requirements the division prescribes; (3) Meets the experience requirements the division prescribes by rule; (4) Has at least one year of experience installing manufactured housing under the supervision of a licensed manufactured home installer if applying for licensure after January 1, 2006; (5) Has completed an installation training course the division approves, which may be offered by the Ohio manufactured homes association or other entity; (6) Receives a passing score on the licensure examination the division administers; (7) Provides information the division requires to demonstrate compliance with this chapter and the rules the division adopts; (8) Provides the division with three references from persons who are retailers, manufacturers, or manufactured home park operators familiar with the person's installation work experience and competency, with at least two of the three referenc

    Section 4740.04 - Ohio Revised Code | Ohio Laws

    The administrative section of the Ohio construction industry licensing board is responsible for the administration of this chapter and shall do all of the following: (A) Schedule the contractor examinations each of the other sections of the board directs. Each type of examination shall be held at least four times per year. (B) Select and contract with one or more persons to do all of the following relative to the examinations: (1) Prepare, administer, score, and maintain the confidentiality of the examinations; (2) Be responsible for all the expenses required to fulfill division (B)(1) of this section; (3) Charge an applicant a fee in an amount the administrative section of the board authorizes for administering the examination. (C) Issue and renew licenses as follows: (1) Issue a license to any individual who the appropriate specialty section of the board determines is qualified pursuant to section 4740.06 of the Revised Code to hold a license and has attained, within the twelve months preceding the individual's application for licensure, a score on the examination that the appropriate specialty section authorizes for the licensed trade.     License application

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09. The application shall be on the form the section prescribes.

    (B) To qualify to take an examination, an individual shall: be at least eighteen years of age; be a United States citizen or legal alien; either have been a tradesperson in the type of licensed trade for not less than five years immediately prior to the application date, be a currently registered engineer in this state with three years of business experience in the construction industry, or have other experience acceptable to the appropriate specialty section; maintain contractor's liability insurance; and not have violated this chapter, obtained a license through fraud, or engaged in fraud or deception in business conduct.

    (C) For an individual who holds an out-of-state occupational license that is substantially similar, to qualify to take an examination, the individual shall provide proof of authorizations for construction, tax returns reflecting income earned, and proof tha

    License application

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09. The application shall be on the form the section prescribes.

    Section 715.27 - Ohio Revised Code | Ohio Laws

    (A) Any municipal corporation may: (1) Regulate the erection of fences, billboards, signs, and other structures, within the municipal corporation, and provide for the removal and repair of insecure billboards, signs, and other structures; (2) Regulate the construction and repair of wires, poles, plants, and all equipment to be used for the generation and application of electricity; (3) Provide for the licensing of house movers; plumbers; sewer tappers; vault cleaners; and specialty contractors who are not required to hold a valid license issued pursuant to Chapter 4740. of the Revised Code; (4) Require all specialty contractors other than those who hold a valid license issued pursuant to Chapter 4740. of the Revised Code, to successfully complete an examination, test, or demonstration of technical skills, and may impose a fee and additional requirements for a license or registration to engage in their respective occupations within the jurisdiction of the municipal corporation. (B) No municipal corporation shall require any specialty contractor who holds a valid license issued pursuant to Chapter 4740. of the Revised Code to complete an examination, test, or demonstration of technic

    Section 4764.02 of the Revised Code does not apply to any person described as follows if the person is acting within the scope of practice of the person's respective profession: (A) A person who is employed by or whose services otherwise are retained by this state or a political subdivision of this state for the purpose of enforcing building codes; (B) A person holding a valid certificate to practice architecture issued under Chapter 4703. of the Revised Code; (C) A person registered as a professional engineer under Chapter 4733. of the Revised Code; (D) A heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, or hydronics contractor who is licensed under Chapter 4740. or section 3781.102 of the Revised Code or who is licensed or registered under section 715.27 of the Revised Code; (E) A real estate broker, real estate salesperson, foreign real estate dealer, or foreign real estate salesperson who is licensed under Chapter 4735. of the Revised Code; (F) A real estate appraiser who is licensed under Chapter 4763. of the Revised Code; (G) A public insurance adjuster who holds a valid certificate of authority issued

    Rule 4781-8-06 | Education for applicants.

    (A) General education requirements for installer's license applications. (1) An applicant shall successfully complete twelve hours of initial licensing education as set forth in paragraph (A)(2) of this rule. The required education shall be completed within one year of the date of application. Credit shall only be given for courses that have been approved by the division. (2) The curriculum of any initial licensing education course shall include instruction in the following areas: (a) Ohio law governing manufactured home installation; (b) Manufacturers' installation manuals and requirements; (c) Preparation of manufactured home sites, including drainage; (d) Installation of foundation systems, including calculation of loads from roof to column to footing, and calculation of footing size; (e) Blocking, perimeter support, and leveling of manufactured homes; (f) Connections of sections and components; (g) Installation of anchoring systems and components; (h) Installation of vapor barriers, curtain walls, access, and ventilation for crawl space areas; (i) Instruction in all areas included on inspection checklists on forms provided by the division; (j) Work place safety for installers;

    (A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09 of the Revised Code. The application shall be on the form the section prescribes. The applicant shall provide information satisfactory to the section showing that the applicant meets the requirements of division (B), (C), or (D) of this section. (B) To qualify to take an examination, an individual shall: (1) Be at least eighteen years of age; (2) Be a United States citizen or legal alien who produces valid documentation to demonstrate the individual is a legal resident of the United States; (3) Either have been a tradesperson in the type of licensed trade for which the application is filed for not less than five years immediately prior to the date the application is filed, be a currently registered engineer in this state with three years of business experience in the construction industry in the trade for which the engineer is applying to take an examination, or have other experience acceptable to the appropriate specialty section of the b

    Section 4740.12 - Ohio Revised Code | Ohio Laws

    (A) No political subdivision, district, or agency of the state may adopt an ordinance or rule that requires contractor registration and the assessment of a registration or license fee unless that ordinance or rule also requires any contractor who registers and pays the registration or license fee to be licensed in the contractor's trade pursuant to this chapter. (B) Except as provided in division (A) of this section, nothing in this chapter shall be construed to limit the operation of any statute or rule of this state or any ordinance or rule of any political subdivision, district, or agency of the state that does either of the following: (1) Regulates the installation, repair, maintenance, or alteration of plumbing systems, hydronics systems, electrical systems, heating, ventilating, and air conditioning systems, or refrigeration systems; (2) Requires the registration and assessment of a registration or license fee of tradespersons who perform heating, ventilating, and air conditioning, refrigeration, electrical, plumbing, or hydronics construction, improvement, renovation, repair, or maintenance.

    (A) In accordance with Chapter 119. of the Revised Code, the superintendent of industrial compliance shall adopt rules pertaining to all of the following: (1) The issuance and renewal of elevator mechanic's licenses and elevator contractor's licenses; (2) The list of disqualifying offenses required under division (B) of section 9.79 of the Revised Code. (B) In accordance with Chapter 119. of the Revised Code, the superintendent may adopt rules pertaining to all of the following: (1) Assisting in the development of public awareness programs; (2) Classifications or subclassifications of licenses for elevator mechanics and elevator contractors; (3) Monitoring inspections and testing in order to ensure satisfactory performance by licensees; (4) Fee schedules for elevator mechanic and elevator contractor licenses. The fees shall reflect the actual costs and expenses necessary to administer this chapter. (5) Establishing standards for the approval of license testing agencies, pursuant to division (D)(1)(b) of section 4785.04 of the Revised Code; (6) Establishing standards for the approval of continuing education and training providers, pursuant to division (B) of section 4785.041 of the

    (A) The division of industrial compliance may delegate to the the Ohio construction industry licensing board any of its duties set forth in sections 4781.04 to 4781.15 of the Revised Code. (B) The division may enter into a contract with the Ohio manufactured homes association or another entity to administer the dispute resolution program created pursuant to section 4781.04 of the Revised Code. The contract shall specify the terms for the administration of the program. (C)(1) The division may enter into a contract with any private third party, municipal corporation, township, county, state agency, or the Ohio manufactured homes association, or any successor entity, to perform any of the division's functions set forth in sections 4781.04 to 4781.15 of the Revised Code that the division has not delegated to the Ohio construction industry licensing board. Each contract shall specify the compensation to be paid to the private third party, municipal corporation, township, county, state agency, or the Ohio manufactured homes association, or successor entity, for the performance of the division's functions.     (A) An elevator contractor shall notify the division of industrial compliance within the department of commerce when there are no licensed elevator mechanics available to provide conveyance services and may request that the division issue temporary elevator mechanic's licenses to individuals certified by the licensed elevator contractor to have an acceptable combination of documented experience and education to provide conveyance services without direct and immediate supervision. (B) Any individual certified by an elevator contractor to have an acceptable combination of documented experience and education to provide conveyance services without direct and immediate supervision shall immediately seek a temporary elevator mechanic's license from the division and shall pay an application fee as set by the division. If the division is satisfied as to the individual's qualifications, the division shall issue a temporary elevator mechanic's license to the individual. (C) A temporary license issued under this section is valid only for a specified term set by the division, which shall be noted on the license, and only while the licensee is employed by the elevator contractor that certified

    When the services of an engineer are required with respect to roads, turnpikes, ditches, bridges, or any other matter, and when, on account of the amount of work to be performed, the board of county commissioners deems it necessary, upon the written request of the county engineer, the board may employ a registered professional engineer and as many assistant engineers, rodmen, and inspectors as are needed, and may also enter into contracts with any person, firm, partnership, association, or corporation qualified to perform engineering services in the state for this purpose and fix the compensation therefor. In awarding such contracts the board shall not be required to comply with sections 153.40 and 5555.61 of the Revised Code. If no such contract is entered into, the board shall furnish suitable offices, necessary books, stationery, instruments, and implements for the proper performance of the duties imposed on the engineer, assistant engineers, rodmen, and inspectors by such board.

    (A) At the time the division of real estate grants the application of any person for a license as a manufactured housing dealer, manufactured housing broker, or manufactured housing salesperson, the division shall issue to the person a license that includes the name and business and mailing address of the person licensed. If a manufactured housing dealer or manufactured housing broker has more than one place of business in a county, the dealer or broker shall make application, in such form as the division prescribes, for a certified copy of the license issued to the dealer or broker for each place of business in the county. (B) The division of real estate may require each applicant for a manufactured housing dealer's license, manufactured housing broker's license, and manufactured housing salesperson's license issued under this chapter to pay an additional fee, which shall be used by the division to pay the costs of obtaining a record of any arrests and convictions of the applicant from the bureau of identification and investigation.
